Customers found engaging in activities prohibited by this policy may face serious consequences, including service suspension and account termination. In extreme cases, we may be legally obligated to report such individuals to relevant authorities for further action.

Fair Use

We encourage fair use of our facilities in alignment with our provided service terms. Excessive usage beyond typical expectations may result in additional fees or capacity restrictions. Our commitment to promoting a positive online environment extends to opposing all forms of abuse, discrimination, rights infringement, and actions that cause harm to individuals, groups, or resources.

Customer Accountability

Customers are responsible not only for their own actions but also for those of anyone using our Products with their authorization. This accountability extends to unauthorized use resulting from inadequate security measures. By accepting our Products, customers commit to ensuring compliance with this policy on behalf of their end users. Complaints concerning customer or end-user actions will be directed to the designated contact for the account in question.

Prohibited Activities

Copyright Infringement and Unauthorized Material

Our Products must not be used to transmit, distribute, or store any material that violates applicable laws, including but not limited to:

• Material protected by intellectual property rights used without proper authorization.
• Obscene, defamatory, or threatening material.
• Material violating export control laws.

Customers are solely responsible for the content they upload or create on our Products and must obtain legal permission to use any copyrighted works included in such content.

SPAM and Unauthorized Message Activity

Our Products must not be used for sending unsolicited bulk or commercial messages (spam). This includes sending spam, soliciting customers from spam sent by others, and collecting replies to spam. Our Products must not be used for unconfirmed mailing lists or telephone number lists (“messaging lists”). All messaging lists must be “confirmed opt-in.”

Unethical, Exploitative, and Malicious Activity

Our Products must not be used for advertising, transmitting, or making available any software, program, product, or service violating this policy or the policies of other service providers. This includes activities such as spamming, network sniffing, pinging, packet spoofing, flooding, mail-bombing, and denial-of-service attacks.

Our Products must not be used to gain unauthorized access to accounts or electronic resources (“hacking”, “cracking”, “phreaking”, etc.). Deliberate introduction of viruses or malicious code is prohibited. Harassment, hate-speech, and any form of discrimination are also strictly prohibited.

Other Unethical and Malicious Activities

Activities involving fraud, attempts to avoid payment, unauthorized access, alteration, or destruction of information, interference with network use, and intentional spreading of viruses or malicious code are all prohibited.

Unauthorized Use of Backseat Gaming Property

Impersonation or misrepresentation of Backseat Gaming or its properties, including Products and brand, for fraudulent purposes is strictly prohibited.

Policy Modifications

This policy outlines a non-exhaustive list of prohibited activities. We reserve the right to modify this policy by publishing revised versions on our website. These revisions become effective when:

• A customer uses our Products after the revised version is published.
• 30 days after the revised version is published.
